Terms of service

1. Agreement

These terms are a binding agreement between you and AgentMotif, a trade name of Digital Ads, LLC, 9430 Warner Ave, Suite C, Fountain Valley, CA 92708 ("AgentMotif", "we", "us"). They apply to your use of www.agentmotif.com (the "Site") and to every order you place. By placing an order, creating an account or using the Site, you agree to them. If you do not agree, do not use the Site or place an order. We sell to customers in the United States.

We may update these terms at any time. The terms in effect when you place your order apply to that order. Please review them at checkout.

2. Ordering and payment

  • All orders must be placed through the Site checkout. By placing an order you confirm that you have read these terms and the Refund Policy.
  • Full payment is due when you order. You confirm that you are the authorized holder of the payment method and that the billing information is correct.
  • Written quotes are valid for 30 days. Prices may change because of material or labor costs. Taxes are calculated at checkout.
  • Product, price or availability errors may exist on the Site. We may correct them and cancel and refund an affected order.

3. Cancellations

You may cancel within 3 hours of placing your order, if your proof has not been approved. To cancel, email sales@print5k.com with your order number. After that time, or once you approve a proof, production starts and the order cannot be canceled. If we agree to a later cancellation, fees covering work done, labor and materials apply, with a minimum fee of $20.

4. Proofs and approval

  • Custom and personalized items are made only after you approve a proof. We send the proof to the email address on your order. Production does not start until we receive your written approval.
  • Written approval means clicking the approval button in the proof email or replying from the email address on your order with the approval sentence in the email. A time-stamped record of your approval, the proof and your order is kept and may be used to show that you approved.
  • Before you approve, check all text, spelling, names, phone numbers, email and website addresses, colors, size, quantity and images. You are responsible for every detail you submit and approve. We do not proofread for meaning or correctness.
  • Errors that appear in a proof you approved are your responsibility, including errors in files, text or content that you supplied. We will not reprint, refund or credit them.
  • Screens do not show printed color exactly. Minor color variation between a proof, a screen and the finished item is normal and is not a defect. We do not guarantee color matching, including Pantone or RGB files, which are converted to CMYK and can shift. We do not guarantee color matching on gang-run printing. A printed proof is available on request and may cost extra.
  • Changes after you approve, and new proofs you ask for, may carry a fee (usually $10 or more per page) and may change your production date.

5. Final sale, returns and refunds

  • All items are made to order. All sales are final. We do not accept returns or exchanges, and we do not refund custom or personalized items, except as stated in section 6.
  • We do not refund or reprint because you changed your mind, because of an error in an approved proof, or because of minor color variation.

6. Production defects, damage and claims

  • If your order arrives damaged or has a production defect (for example a print that clearly does not match the proof you approved, the wrong product, or missing items), email sales@print5k.com within 5 business days of delivery with your order number and clear photos. After 5 business days the order is considered accepted.
  • If we confirm a defect, we will reprint or replace the affected items or, at our option, refund the affected items. This is your only remedy for a defect.
  • Carriers are responsible for packages after delivery. We are not responsible for lost or damaged packages caused by the carrier. Shipping insurance is available on request at checkout.

7. Disputes and chargebacks

  • If you have a problem with your order, you agree to contact us first at sales@print5k.com or (714) 444-1818 and give us 10 business days to resolve it before you dispute the charge with your bank or card company.
  • You agree that approved proofs, order records, emails, delivery records and photos of the finished item, kept by us, are accurate records of your order and may be given to your bank, card company or payment processor.
  • If you file a dispute for an order that you ordered, approved and received as described, we may submit this evidence, and you agree to pay our reasonable costs and fees from the dispute, to the extent the law allows. We may also decline future orders.

8. Production and shipping

  • Production time covers production only (about 3 business days after payment and proof approval, up to 5 for larger jobs). Shipping time is separate. Daily production cutoff is 10:00 AM Pacific Time. Files must be print-ready to qualify for same-day processing.
  • Delivery dates are estimates, not guarantees. Delays can happen for weather, natural disasters, strikes, government actions or other events we do not control, and carrier delays.
  • We may use a different production or shipping method than you selected to deliver on time or sooner.
  • You must give a correct shipping address. Extra carrier fees, reshipping fees and lost packages caused by a wrong address are your responsibility. Once a package has left us we cannot change the address.

9. Your content

  • You must give us enough content and instructions to do the work. You confirm that you own or have the right to use everything you send us (text, logos, photos, designs, trademarks) and that it does not infringe anyone's rights.
  • You keep ownership of your content. You give us a non-exclusive, worldwide, royalty-free license to use it to make your order and to show finished work as a sample or in our marketing, unless you ask us in writing not to.
  • We may refuse any content that is illegal, offensive, obscene, defamatory, harmful or infringing, and may cancel and refund that order.
  • Design files and materials we create (designs, files, plates and similar) stay ours until you have paid in full.
  • You agree to defend and hold harmless AgentMotif and its owners, employees and agents from claims, damages and costs, including reasonable attorneys' fees, that come from your content, your breach of these terms or your use of our services.

10. Customer responsibilities, quantities and extras

  • Proofread all files, request Pantone matching if you need it, give complete specifications and give written approval based on the proof we send.
  • Changes beyond the original specifications, errors in specifications and delays caused by you may cost extra, including overtime charges.
  • Quantity can vary because of production limits: up to 10,000 units, plus or minus 7%; 10,001 to 25,000, 5%; 25,001 to 100,000, 3%; over 100,000, 2%. You are billed for the quantity delivered.
  • We are not responsible for the quality, accuracy or shortages of materials you supply. We may store materials at no charge when space allows, and are not liable for loss or damage in storage.
  • We may use subcontractors and remain responsible for your order.

11. Use of the Site

  • The Site and everything on it (code, design, text, photos, graphics, trademarks and logos) belong to us or our licensors and are protected by law. You may not copy, modify, reverse engineer, mirror or use the Site materials for any commercial purpose, or remove any copyright notice.
  • You confirm that you are at least 18, have legal capacity to agree to these terms, will give true and current information, will not use bots or automated tools to access the Site and will not use the Site for anything illegal.
  • If you open an account, you are responsible for keeping your password secret and for all activity on it. Tell us right away if you see unauthorized use.
  • We may suspend or end access to the Site for anyone who gives false information or breaks these terms.
  • The Site may contain typos, pricing or other errors. We may correct them at any time.

12. Disclaimer and limits of liability

THE SITE AND ITS MATERIALS ARE PROVIDED "AS IS". WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT ENDORSE OR TAKE RESPONSIBILITY FOR ANY THIRD-PARTY PRODUCT, SERVICE OR LINKED SITE.

TO THE MAXIMUM EXTENT THE LAW ALLOWS, OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE PRICE YOU PAID FOR THE ORDER, AND WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST BUSINESS OR LOSS OF DATA, EVEN IF WE WERE TOLD THEY COULD OCCUR. SOME PLACES DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.

13. Confidentiality

We keep your communications and project information confidential and do not share them with unauthorized parties, except as needed to make and deliver your order, to our service providers, to our payment processor or bank when needed to respond to a dispute, or as the law requires.

14. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Courts in Orange County, California have jurisdiction, unless the law requires otherwise.
